1. Who we are

These Terms & Conditions ("Terms") are a binding agreement between you and Seven Sunsets Travel LLC, an Indiana limited liability company with its principal place of business at 5534 Saint Joe Road, Fort Wayne, IN 46835 (referred to in these Terms as "Seven Sunsets," "we," "us," or "our"). By accessing or using sevensunsets.travel and related services (the "Service"), you agree to be bound by these Terms.

2. The Service

Seven Sunsets sells digital travel itineraries delivered as downloadable PDF documents. Itineraries include hand-picked hotel recommendations, day-by-day plans, and curated excursion suggestions. Some recommendations contain affiliate links to third-party booking platforms (such as Booking.com, GetYourGuide, and Viator); we may earn a commission when you book through those links at no extra cost to you. Seven Sunsets is not a travel agency, tour operator, or seller of travel within the meaning of any state law; we sell informational content only.

3. Eligibility & acceptance

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from us. By continuing to use the Service you confirm you have the authority to enter into these Terms. If you're using the Service on behalf of an organization, you confirm you have authority to bind that organization.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• infringe the intellectual property, privacy, or other rights of any person;
• send spam, malware, or attempt to probe, scan, or interfere with our systems;
• scrape, copy, or republish our itineraries, copy, or website without our written permission;
• circumvent any access controls, rate limits, or technical restrictions.

5. Intellectual property

All content, copy, design, code, photography, itineraries, and templates on the Service are owned by Seven Sunsets Travel LLC or its licensors and protected by copyright and other intellectual property laws. When you purchase an itinerary, you receive a personal, non-exclusive, non-transferable, non-sublicensable license to use the PDF for your own travel planning. You may not resell, republish, redistribute, or share the PDF publicly.

6. Payments & merchant of record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By placing an order, you also agree to Paddle's Buyer Terms, which govern payment, billing, tax, and refund mechanics.

Prices are listed in U.S. dollars unless otherwise noted. Itineraries are delivered electronically as a PDF; standard tiers are delivered immediately on successful payment, and the $149 custom itinerary tier is delivered within 48–72 hours.

At checkout, customers may optionally add a $5 donation to the Karen Wellington Foundation (KWF). 100% of donations collected through checkout are forwarded to the KWF. The donation is shown as a separate line item and is not part of the itinerary price.

7. Refunds

Itineraries are digital PDFs delivered instantly on payment. We do not offer change-of-mind refunds after delivery, but we provide a 14-day guarantee covering undelivered, defective, or materially inaccurate itineraries. 8. Third-party bookings & travel responsibility

The Service provides recommendations only. Any reservations you make with hotels, tour operators, airlines, or other third parties (whether through our affiliate links or directly) are governed by the terms of those third parties, and any disputes arising from those bookings are between you and the third-party provider. We are not responsible for the availability, quality, safety, pricing, or any other aspect of third-party travel services. You are responsible for verifying current pricing, opening hours, visa and entry requirements, vaccinations, travel insurance, and any other travel documentation needed for your trip.

9. No warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any recommendation will meet your expectations.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amount you paid Seven Sunsets in the 12 months preceding the claim, or (b) USD $100. We will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (such as fraud, gross negligence, or personal injury).

11. Indemnification

You agree to indemnify and hold harmless Seven Sunsets Travel LLC and its members, officers, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, your violation of any third-party right, or any travel or booking you arrange based on our recommendations.

12. Suspension & termination

We may suspend or terminate your access to the Service at any time for: a material breach of these Terms; non-payment; suspected fraud or security risk; or repeated or serious policy violations. You may stop using the Service at any time.

13. Changes

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be highlighted on this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Indiana, USA, without regard to its conflicts of laws rules. The exclusive venue for any dispute arising out of or relating to these Terms is the state or federal courts located in Allen County, Indiana, and you consent to the jurisdiction of those courts.
